Terms of Service
These Terms of Service govern your access to and use of YieldBI, a marketing campaign management platform.
1. Acceptance of terms
These Terms of Service ("Terms") form an agreement between YieldBI ("we", "us") and you. By accessing or using the YieldBI platform, you agree to these Terms. If you are accepting on behalf of a company or other organization, you represent that you have authority to bind that organization.
2. The service
YieldBI provides marketing campaign management, monitoring, and execution capabilities, including creative generation, campaign and ad-set management, conversion tracking, and performance optimization. Subject to these Terms, we grant you a non-exclusive, non-transferable license to use YieldBI for your internal business purposes. We may modify or update the service from time to time and will provide notice of material changes where reasonably practicable.
3. Accounts
You must provide accurate and complete information when registering for an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorized access or use of your account.
4. Platform integrations
YieldBI connects with third-party advertising platforms, including Meta, Google Ads, and TikTok. When you connect an account, you authorize YieldBI to access and act on campaign data on your behalf as configured in the platform. You represent and warrant that you have the necessary rights to share any data you connect or upload, and that your use of connected platforms complies with their respective terms and policies.
5. Fees and payment
Subscription fees are billed in advance on the plan cycle you select, are exclusive of applicable taxes, and are charged to the payment method on file. Fees are non-refundable except where required by law or expressly stated otherwise. We may change our pricing with advance notice; continued use of the service after a price change takes effect constitutes acceptance of the new pricing.
6. Intellectual property
YieldBI and its licensors retain all rights, title, and interest in the platform, including its software, design, and underlying technology. You retain ownership of the content, assets, and data you upload or generate through the platform ("Customer Content"), and you grant us a limited license to host, process, and display Customer Content solely to provide the service to you.
7. Confidentiality
Each party agrees to protect the other's confidential information disclosed in connection with these Terms with at least the same degree of care it uses to protect its own confidential information, and not to disclose it to third parties except as permitted under these Terms or by law.
8. Data protection
We implement administrative and technical security measures designed to protect data processed through YieldBI and retain data only for as long as necessary to provide the service. Where we transfer data internationally, we apply appropriate safeguards. Our handling of personal data is further described in our Privacy Policy, and we comply with applicable requirements under the GDPR and CCPA/CPRA.
9. Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind, express or implied, except as expressly stated in these Terms. To the maximum extent permitted by law, YieldBI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the service.
10. Termination
Either party may terminate the agreement as set out in your order form or, absent one, with notice as provided in these Terms. Upon termination, you must stop using the service and settle any outstanding fees. We will make your data available for export for a reasonable period following termination, after which it may be deleted in accordance with our data retention practices.
11. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes, and your continued use of YieldBI after such changes take effect constitutes your acceptance of the updated Terms.
